The special counsel's statement announcing the appeal reinforces that Cannon's ruling is out of step with other courts and that Smith isn't operating as a rogue.

It’ll go to the 11th Circuit Court of Appeals, since that’s where Florida is.

  Note that the 11th Circuit has slapped Cannon down before. I hope they do it again.
